Welcome to AssignPulse. These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and field service management tools. By creating an account or using our services, you agree to be bound by these Terms.

1. Account Registration and Security

To use AssignPulse, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are responsible for safeguarding your password and for any activity or actions under your account.

2. Subscription, Billing, and Cancellation

  • Billing: AssignPulse offers various subscription plans billed on a recurring monthly or yearly basis. Payments are processed securely via Stripe.
  • Fee Changes: We reserve the right to change our subscription fees upon prior notice. Any rate changes will apply to the subsequent billing cycle.
  • Cancellation: You can cancel your subscription at any time through your dashboard settings. Upon cancellation, your service will remain active until the end of your current billing period.
  • Refunds: Except as required by law (including Australian Consumer Law), subscription fees are non-refundable.

3. Customer Content and Data Ownership

You retain all rights, title, and interest in and to the data, text, photos, and other materials you upload or enter into our services ("Customer Content"). By uploading content, you grant AssignPulse a worldwide, non-exclusive, royalty-free license to host, store, and process your content solely to provide the services to you.

4. Acceptable Use Policy

You agree not to use the services to:

  • Violate any applicable laws, regulations, or third-party rights.
  • Upload or transmit viruses, malware, or any other malicious code.
  • Attempt to gain unauthorized access to our servers, databases, or systems.
  • Reverse engineer, decompile, or disassemble any aspect of our services.
  • Spam or harass any staff, clients, or other users.

5. Limitation of Liability

To the maximum extent permitted by law, AssignPulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the services.

6. Disclaimer of Warranties

Our services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
